Firm pricing follows two rules:

1. Charge flat fees whenever possible to provide fair, predictable costs.

2. Unbundle services so that you only pay for what you need, when you need it.

NOTE: The USPTO fees mentioned below are fees that the USPTO assesses regardless of whether you use an attorney. That is, you’ll have to pay those fees even if you file a document yourself.

Flat Fee Services

  • Haven’t yet decided on your company or product name? Let Andy teach you a few rules that will help you pick a stronger mark and avoid a weaker or unregistrable one. If you purchase this service and then later file a Trademark Application with Andy, the entire cost of this coaching session will be applied toward the fees for one trademark filing.

    $150 (no USPTO fees required)

  • A search for your mark within the USPTO database and online (exact and near matches), including a discussion of the results. See trademark searching for more information.

    $200 (no USPTO fees required)

  • A search via professional software to compile a trademark report that includes results from state and federal databases, internet pages, state business registries, social media, and common law sources. Includes a thorough review of this report, an opinion letter on the viability of your desired mark, and discussion of the results. See Trademark Searching for more information.

    $500 (no USPTO fees required)

  • The preparation and filing of your application, a response to any non-substantive office actions, and filing the Statement of Use in intent-to-use applications.

    $800 + USPTO Fees

  • Renewals, allegations/statements of use, requests to divide, specimen filings (if Andy did not file your original application), and more.

    $200 + USPTO Fees

Variable Rate Services

Hourly Rate: $300/hour

  • Disclaimers, class description errors, etc. NOTE: this service is provided free of charge if Andy filed your application.

    Typically requires 0.5-2 hours.

  • Responses to office actions covering likelihood of confusion and others requiring memo drafting and argument. This is the most open-ended service Andy provides, as the hours required can vary greatly depending on complexity. Andy will charge nothing to briefly review your office action to estimate cost, but his ability to give a precise estimate is limited.

    Typically requires 3-6 hours.

  • Other services and customized work.

    Time estimate determined on a case-by-case basis.
